Persian Hand
How do I help a person execute a will who has no speech or use of his arms?
He has fully looked over and agrees with an advanced copy of the will.
He lost his left hand in the 1991 persian gulf war.
Preferably Mass. Law
How does he communicate?
Check your state’s law to see what provisions, if any there are for execution of a will by someone not able to write. Follow those procedures, if any.
In addition, I’d set up the execution as follows:
1. Have the entire execution videotaped with special attention to having his responses clearly taped.
2. Have someone read the entire will to him.
3. Ask if he understands the will: get affirmative communication from him.
4. Ask if he wants it to be his will: get affirmative communication from him.
5. Ask if he wants to execute will today: get affirmative communication from him.
6. Follow procedure set out in the state’s code.
6. If no procedure ask if he wants someone to place his fingerprint on the will as his execution of it. Do so.
7. Have witnesses sign will.
8. End videotaping.
9. Seal videotape inside envelope. Have witnesses sign across flap.
